Approved Break in Participation

Q: How long can a SCSEP participant be put on an approved break before they should be exited from the program? Are there different rules depending on the type of hold, for instance, a medical hold vs an administrative hold? Is this an internal decision for each organization?

Q: Grantees are required to have a policy governing approved breaks in participation, including breaks for necessary sick leave. The grantee can establish its own standards, including reasons for an approved break, permissible length of the break, and reporting requirements. However, grantees must allow for necessary sick leave and cannot terminate participants who are in compliance with the reporting requirements but are medically unable to return to work at the specified time.

You cannot terminate a participant for administrative reasons; however, if you have placed a participant on leave for administrative reasons for a violation of program requirements or grantee rules, e.g., while you are investigating whether the participant committed fraud or committed wilful misconduct, or while you are waiting for the 30-day termination letter for similar offenses to expire, you may end the approved break and terminate the participant at the appropriate time for the underlying offense.
