Driving Assignment for SCSEP Participant

Q: If a SCSEP participant has a valid driver's license, a clean driving record, and is being covered under insurance, is it permissible to assign the participant to driving duties at a host agency?

A: Yes. DOL has previously said is that there is no prohibition against participants driving. Some grantees may not allow participants to be assigned to driving positions because of worker’s comp or liability issues, but there is no program rule that prevents driving. In fact, if a participant’s employment goal is for a job that includes driving, not letting a participant drive would be a problem.

There are many grantees that assign participants to positions that involve driving, e.g., delivering Meals on Wheels lunches. However, a participant cannot be forced to use his or her own car. A grantee should ensure that if the participant does use his or her vehicle, the host agency reimburses the participant fully. Reimbursement up to the amount of the IRS rate is not income to the participant for purposes of income tax or SCSEP eligibility.
